1. Overview

Welcome to Simple Advocate. These Terms of Service ("Terms") govern your access to and use of the Simple Advocate platform, including our website, web application, tools, features, and any related services (collectively, the "Platform").

By creating an account or using the Platform, you agree to these Terms. If you do not agree, please do not use Simple Advocate.

Simple Advocate LLC ("Simple Advocate," "we," "our," "us") is a technology company that provides a secure, parent-managed digital platform to help individuals store, organize, and manage medical, educational, developmental, and personal documents, along with related notes, appointments, and resources.

2. Eligibility

To use Simple Advocate, you must:

  • Be at least 18 years old
  • Be a legal parent, guardian, or authorized caregiver of the individual(s) whose information you manage
  • Provide accurate and complete registration information
  • Agree to comply with these Terms and all applicable laws

Simple Advocate is not intended for use by minors. All accounts must be created and managed by an adult.

3. Account Registration and Security

When you create an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your login credentials
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activity under your account

We reserve the right to suspend or terminate accounts that violate these Terms, are inactive for extended periods, or are used fraudulently.

4. What Simple Advocate Provides

Simple Advocate offers tools to help you:

  • Upload, store, and organize personal, medical, and educational documents
  • Track appointments, milestones, and tasks
  • Use AI-powered tools to summarize, analyze, and organize information
  • Access educational resources and guides
  • Manage your child's care and advocacy journey in one place

4.1 Important Limitations

Simple Advocate is not:

  • A healthcare provider
  • A legal services provider
  • A substitute for professional medical, legal, or educational advice
  • A HIPAA Covered Entity (unless a BAA is signed with a Covered Entity)

Information provided through the Platform — including AI-generated summaries, suggestions, and resources — is for informational and organizational purposes only and should not be relied upon as professional advice.

5. AI-Powered Tools

Simple Advocate includes AI-powered features that may:

  • Summarize uploaded documents
  • Suggest questions or talking points
  • Organize information into timelines or categories
  • Generate draft letters or meeting preparation notes

AI outputs are generated based on the information you provide and are intended as a starting point, not a final product. You are responsible for reviewing, editing, and verifying all AI-generated content before using it in any professional, legal, or medical context.

Simple Advocate does not guarantee the accuracy, completeness, or suitability of AI-generated content.

6. User Content and Ownership

You retain full ownership of all documents, notes, and information you upload or create on the Platform ("User Content").

By using Simple Advocate, you grant us a limited, non-exclusive license to:

  • Store and process your User Content to provide the Platform's services
  • Use anonymized, aggregated data to improve the Platform (no personally identifiable information is included)

We will never sell, license, or share your User Content with third parties for advertising or marketing purposes.

7. Subscription Plans and Billing

7.1 Plans

Simple Advocate offers subscription-based access. Plan details, pricing, and features are described on our Pricing page.

7.2 Billing

  • Subscriptions are billed on a recurring basis (monthly or annually) depending on the plan selected
  • Payment is processed through Stripe, our third-party payment processor
  • You authorize us to charge your payment method on file for each billing cycle

7.3 Free Trials

We may offer free trial periods. At the end of a trial, your subscription will automatically convert to a paid plan unless you cancel before the trial ends.

7.4 Cancellation

  • You may cancel your subscription at any time through your account settings
  • Cancellation takes effect at the end of the current billing period
  • You will retain access to paid features until the end of your billing cycle

7.5 Refunds

Refunds are handled on a case-by-case basis. If you believe you are entitled to a refund, please contact us at [email protected]. We aim to respond within 5 business days.

Refunds are generally not provided for partial billing periods or unused time on a subscription. However, we may issue refunds in cases of billing errors, duplicate charges, or extenuating circumstances.

8. Acceptable Use

You agree not to:

  • Use the Platform for any unlawful purpose
  • Upload harmful, fraudulent, or misleading content
  • Attempt to access other users' accounts or data
  • Reverse-engineer, copy, or redistribute the Platform or its features
  • Use the Platform to harass, threaten, or harm others
  • Interfere with the operation or security of the Platform

We reserve the right to suspend or terminate accounts that violate these rules.

9. Privacy and Data Protection

Your use of Simple Advocate is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.

All content, design, code, features, and branding of the Simple Advocate Platform are owned by Simple Advocate LLC and protected by intellectual property laws.

You may not:

  • Copy, modify, or distribute any part of the Platform
  • Use our name, logo, or branding without written permission
  • Create derivative works based on the Platform

11. Disclaimers

The Platform is provided "as is" and "as available." We make no warranties, express or implied, regarding the Platform's reliability, accuracy, or fitness for a particular purpose.

We do not guarantee that:

  • The Platform will be uninterrupted or error-free
  • AI-generated content will be accurate or complete
  • The Platform will meet all of your specific needs

12. Limitation of Liability

To the fullest extent permitted by law, Simple Advocate LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to loss of data, loss of profits, or interruption of service.

Our total liability for any claim related to the Platform shall not exceed the amount you paid to us in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Simple Advocate LLC, its officers, employees, and agents from any claims, damages, or expenses arising from your use of the Platform, your violation of these Terms, or your violation of any third-party rights.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Georgia, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA), unless you opt out within 30 days of creating your account by emailing [email protected].

15. Changes to These Terms

We may update these Terms from time to time. If we make significant changes, we will notify you through email or in-app alerts. Continued use of the Platform after changes are posted constitutes acceptance of the updated Terms.
